How the Sex Offender Registry Program works:

* Primarily, the Sex Offender Registry program is predicated upon the cooperation and compliance from the convicted sex offender. The Criminal History Repository relies on seven other entities to produce a successful program. NRS 179D.150 defines the requirement and procedures for establishing a record of registration with the cooperation of local law enforcement agencies.

* Any offender who, after July 1, 1956, has been convicted of a crime against a child pursuant to NRS 179D.210 or convicted of a sexual offense listed in NRS 179D.410 shall register with a local law enforcement agency in the jurisdiction in which the offender resides pursuant to NRS 179D.240 and 179D.460. In addition, the convicted sex offender is required to register with local law enforcement within 48 hours of residing or being released from custody in a county or incorporated city. Failure to register is a category D felony under NRS 179D.290 and 179D.550.

* NRS 179D.260 and 179D.480 require the convicted sex offender to complete an annual verification form. This annual verification form will be mailed to the offender’s last known address. It is incumbent on the convicted sex offender to submit the verification form to the Criminal History Repository and provide the Sex Offender Registry program with the most current information pursuant to NRS 179D.250 and 179D.470. In addition, failure to notify the local law enforcement agency of a change of address or to provide false or misleading information to the Criminal History Repository is a category D felony under NRS 179D.290 and 179D.550

* Under NRS 179D.710 the Office of the Attorney General shall consult with the Advisory Council for Community Notification and establish guidelines and procedures for community notification. Subsequently, the Nevada Guidelines and Procedures for Community Notification of Adult Sex Offenders were created. The Advisory Council is comprised of members appointed by the Governor and by the Legislative Commission per NRS 179D.700

* Under NRS 179D.230 and 179D.450, if the convicted sex offender is subject to community notification, the Criminal History Repository shall arrange for the assessment of the risk for recidivism of the convicted sex offender pursuant to the guidelines and procedures for community notification established by the Attorney General pursuant to NRS 179D.600 to 179D.800, inclusive.

* A key connection in this program is the role of local law enforcement. Local law enforcement agencies are responsible for tracking convicted sex offenders; and, under NRS 179D.770 are allowed to disclose information regarding the sex offender to the appropriate persons pursuant to the guidelines and procedures established by the Attorney General pursuant to NRS 179D.600 to 179D.800, inclusive.

* Under NRS 176.0926, before imposing sentence: the court shall notify the Criminal History Repository if a defendant is convicted of a crime against a child, so the provisions for registration of the defendant are followed pursuant to NRS 179D.230 Additionally, the court shall inform the defendant of the requirements for registration. However, failure to provide the defendant with the information does not affect the duty of the defendant to register and to comply with all other provisions for registration as stated in NRS 179D.200 to 179D.290, inclusive.
